4. MSHA INFORMATION & TRAINING

References to MSHA, mine safety requirements, Part 46, or other mining-related requirements are provided within the context of applicable training, safety, or compliance-support services.

Mine operators, contractors, employers, and other responsible parties remain responsible for determining and satisfying the requirements applicable to their operations, employees, training plans, documentation, and work activities.

5. EPA & ENVIRONMENTAL TRAINING

References to EPA requirements, lead-safe work practices, renovation activities, environmental programs, asbestos-related training, or other environmental health and safety matters must be considered within the requirements applicable to the specific activity, jurisdiction, and program.

Training or documentation provided by A.R.G. does not eliminate any separate employer, firm, contractor, individual, licensing, certification, notification, permitting, or regulatory obligation that may apply.

6. EM 385 & PROJECT-SPECIFIC REQUIREMENTS

References to EM 385, U.S. Army Corps of Engineers requirements, Site Safety and Health Officer responsibilities, or other project-specific safety requirements are provided for training, informational, or professional-support purposes.

Contractors and other responsible parties must independently determine the current requirements applicable to their contract, project, scope of work, personnel, and activities.

7. TRAINING DOES NOT REPLACE EMPLOYER RESPONSIBILITIES

Training provided by A.R.G. is intended to support occupational safety and health knowledge, skills, awareness, and applicable training requirements.

Completion of a training course does not transfer an employer’s workplace safety responsibilities to A.R.G. Employers remain responsible for providing a safe workplace, identifying and controlling hazards, determining employee competency, providing appropriate supervision, selecting qualified personnel, maintaining required records, and complying with applicable laws, regulations, standards, and contractual requirements.

8. CERTIFICATES, CARDS & COURSE COMPLETION

A certificate, wallet card, training record, or other completion document issued by A.R.G. represents completion only within the scope and requirements of the applicable training program.

Unless specifically established by an applicable law, regulation, program, licensing authority, or written authorization, a course-completion document should not be interpreted as a professional license, governmental license, employer authorization, or guarantee of competency for every workplace or task.

Employers remain responsible for determining whether additional training, evaluation, qualification, authorization, supervision, or documentation is required before assigning an employee to perform particular work.

9. EQUIPMENT OPERATOR TRAINING

Equipment-related training may include classroom instruction, practical instruction, evaluation, or other components depending on the applicable program and service purchased.

Completion of equipment training does not relieve an employer of its responsibility to determine whether an employee is competent, qualified, appropriately evaluated, and authorized to operate specific equipment under the conditions of the workplace.

10. SITE INSPECTIONS & SAFETY OBSERVATIONS

A.R.G. may provide safety inspections, audits, site observations, assessments, and related professional services according to an agreed scope of work.

A site visit or report reflects conditions observed or information reasonably available during the time and scope of the service performed. Unless expressly agreed otherwise in writing, a site observation or inspection is not represented as continuous monitoring or a comprehensive examination of every employee, contractor, condition, hazard, activity, document, or regulatory requirement at a workplace.

Conditions may change before, during, or after an A.R.G. visit. Employers, contractors, owners, supervisors, and other responsible parties remain responsible for ongoing workplace safety and timely correction of hazards.

11. CONSULTING & PROFESSIONAL SERVICES

Recommendations provided through consulting, inspections, reports, training, program development, or other professional services are based on the information and conditions reasonably available within the applicable scope of work.

Implementation of recommendations and final operational decisions remain the responsibility of the employer, client, contractor, owner, or other party with authority and responsibility for the workplace or activity.

12. NO GUARANTEE OF REGULATORY COMPLIANCE

A.R.G. services are intended to assist clients in improving safety performance and supporting compliance efforts. However, no training course, inspection, audit, consultation, program, manual, report, or other service can guarantee that a workplace will be free from hazards, incidents, injuries, violations, citations, penalties, or regulatory action.

Regulatory authorities retain their respective enforcement and interpretive authority.

13. REGULATORY CHANGES

Laws, regulations, standards, agency interpretations, training requirements, and industry practices may change after website content or training materials are published.

Users and responsible parties should verify current requirements through appropriate official sources when making compliance or operational decisions.
